The Site is intended for users who are at least 18 years of age. . By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are accessing the Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
3. Description Of Organization And Site Purpose
Aromananda is a nonprofit foundation dedicated to making holistic wellness accessible to everyone. Since 2005, we’ve partnered with schools, communities, and families to bring yoga, breathwork, mindfulness, nutrition, and social-emotional wellness practices to those who need them most. In 2020, we became a registered 501(c)(3) organization in New York State, expanding our reach and strengthening our purpose across diverse communities.
We are committed to creating a healthier, more vibrant, Blue Zone–inspired community where everyone has the opportunity to thrive. We proudly uplift and empower women, seniors, veterans, teachers, less-privileged groups, and LGBTQ community members to reclaim balance, build confidence, and strengthen social, emotional connections.
The Site is informational in nature and allows visitors to:
- View information about upcoming events hosted by Aromananda;
- Access galleries featuring past events;
- Obtain educational content related to health and wellness;
- Make donations to support Aromananda’s mission and activities.
The Site does not offer goods or services for sale, subscription services, or any commercial transactions.
4. No Account Registration
The Site does not require or permit users to register accounts or create user profiles. . All content on the Site is accessible without login credentials.
5. Nonprofit Mission And Tax-Exempt Status
Aromananda is a nonprofit organization registered in the State of New York and recognized as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. . We do not sell products, endorse third-party services, or promote commercial offerings.
Charitable Solicitation and State Registrations: Aromananda solicits charitable contributions through the Site. To the extent required by applicable law, Aromananda is registered or exempt from registration in jurisdictions where it solicits donations. Users are encouraged to review applicable state charitable solicitation laws. 6. Donations And Payment Processing
6.1 Donation Purpose
The Site provides links and functionality for users to make voluntary charitable contributions to Aromananda. . All donations are subject to Aromananda’s gift acceptance policies and are used to further its tax-exempt charitable mission.

By making a donation, you agree to provide accurate and complete payment information and authorize Aromananda and its payment processors to charge your designated payment method. Aromananda is not responsible for errors or failures by third-party payment processors.
6.4 Donation Refunds

6.5 Recurring Donations
The Site may offer the option to make recurring donations. You may cancel recurring donations at any time by contacting support[at]aromananda.org or through the payment processor’s platform.
6.5 Restricted Gifts
If you designate your donation for a specific program, activity, or purpose, Aromananda will use commercially reasonable efforts to honor that designation. However, Aromananda reserves the right, in its sole discretion, to redirect restricted gifts to similar or related purposes if the designated purpose becomes impracticable, unnecessary, or inconsistent with Aromananda’s mission or applicable law
7. Event And Program Participation
From time to time, Aromananda hosts events, workshops, seminars, and community programs. Information about these activities may be posted on the Site. Participation in any event or program may be subject to additional terms, waivers, or registration requirements communicated separately.
All activities offered through Aromananda’s events, workshops, seminars, and community programs are for educational and informational purposes only.

You should consult a physician before beginning any ne exercise or wellness program.
9. User Conduct And Prohibited Uses
9.1 Acceptable Use
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Site.
9.2 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
(a) Using the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site, including but not limited to spamming, denial-of service attacks, or other harmful conduct;
(b) Using any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission;

(h) Engaging in any conduct that, in Aromananda’s sole judgment, restricts or inhibits any other person from using or enjoying the Site, or that may harm Aromananda or expose Aromananda or its users to liability.
10. No User-Generated Content

18.2 Cap on Liability
To the fullest extent permitted by applicable law, Aromananda’s total aggregate liability to you for any and all claims arising out of or relating to these terms or your use of the site shall not exceed the lesser of (a) fifty dollars ($50.00) or (b) the total amount, if any, paid by you to aromananda during the two (2) months preceding the event giving rise to the claim.
18.3 Basis of the Bargain
You acknowledge and agree that the disclaimers and limitations of liability set forth in these terms reflect a reasonable and fair allocation of risk between you and Aromananda and are fundamental elements of the basis of the bargain between you and Aromananda. You agree to defend, indemnify, and hold harmless Aromananda, its directors, officers, employees, agents, volunteers, partners, collaborators, donors, board members, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys’ fees) arising from:

(c) Your violation of any third-party rights, including, without limitation, any intellectual property, privacy, or other proprietary right;

23. Dispute Resolution
23.1 Informal Negotiations
If you have a dispute with Aromananda arising out of or relating to these Terms or the Site, you agree to first contact Aromananda at support@aromananda.org and attempt to resolve the dispute informally. The parties agree to engage in good-faith negotiations for a period of at least thirty(30) days before initiating any formal dispute resolution proceedings.
23.2 Binding Arbitration
If the dispute cannot be resolved through informal negotiations within thirty (30) days, either party may initiate binding arbitration. . Any dispute, controversy, or claim arising out of or relating to these Terms or the Site, or the breach, termination, or invalidity thereof, shall be finally resolved by binding arbitration administered by [ARBITRATION ADMINISTRATOR, E.G., AMERICAN ARBITRATION ASSOCIATION (AAA) OR JAMS, TO BE INSERTED] in accordance with its [APPLICABLE ARBITRATION RULES, E.G., CONSUMER ARBITRATION RULES, TO BE INSERTED].
The arbitration shall be conducted in the State of New York. . The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
23.3 Arbitration Fees
Each party shall bear its own costs and expenses in connection with the arbitration, including its own attorneys’ fees. The parties shall share equally the fees and expenses of the arbitrator and the arbitration administrator, except as otherwise required by applicable law. Aromananda expressly does not agree to pay arbitration fees regardless of how excessive they may be.
23.4 Class Action Waiver
To the fullest extent permitted by applicable law, you and Aromananda agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Unless both you and Aromananda agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class, consolidated, or representative proceeding.
23.5 Time Limitation on Claims
You agree that any cause of action arising out of or related to these Terms or the Site must be commenced within one (1) year after the cause of action accrues. Otherwise, such a cause of action is permanently barred.
23.6 Exception for Equitable Relief
Notwithstanding the foregoing, either party may seek equitable relief (including injunctive relief) in any court of competent jurisdiction to protect its intellectual property rights or confidential information.

All notices, requests, and other communications under these Terms shall be in writing and shall be deemed to have been duly given when delivered in person, sent by confirmed email, or mailed by certified or registered mail, postage prepaid, return receipt requested, to the following address:

25. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid, illegal, or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent, or if such modification is not possible, such provision shall be severed from these Terms
26. Waiver
No waiver by Aromananda of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by Aromananda to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
27. Entire Agreement
These Terms, together with the Privacy Policy and any other legal notices or policies published by Aromananda on the Site, constitute the entire agreement between you and Aromananda regarding your use of the Site and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Site.
28. Assignment
You may not assign, transfer, or delegate these Terms or your rights or obligations hereunder without Aromananda’s prior written consent. Aromananda may assign, transfer, or delegate these Terms or its rights or obligations hereunder in its sole discretion. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
29. No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you and Aromananda.

The headings and captions used in these Terms are for convenience only and shall not affect the interpretation of these Terms.
